Aardwolf Labs (“Aardwolf”) Terms of Service (“Terms”) are legally binding upon you in the event that you use any service of Aardwolf, including this website, and all linked and associated sites, surveys, applications, and services owned or performed by Aardwolf, its subsidiaries, and affiliates, including marijuana and/or hemp testing (the “Services”).  If you do not consent to these Terms, you should immediately cease using any of Aardwolf’s Services, including this website.  These Terms govern your use and access to Aardwolf’s Services, as supplemented by any other documentation between you and Aardwolf for any specific purpose.  These Terms may be modified at any time and without prior notice to you.  Your continued use of the Services means that you consent to these Terms as they may be modified in the future.  Aardwolf reserves the right to refuse to complete any of the Services in the event you either violate these Terms or are otherwise prohibited from utilizing the Services.

Testing Services

Aardwolf abides by all applicable rules, regulations, and laws, for the Services.  The results of any testing Services are strictly for the requesting party’s use and/or legal compliance.  Further, as Aardwolf tests batches/samples provided by you, Aardwolf makes no representations or warranties as to the quality of any other aspect of a batch/sample not specifically requested to be tested and disclaims any responsibility for the results due to improper batch/sample collection by you.  Results of any testing may be dependent upon the specific batch/samples provided.  

Disclaimer of Warranties

AARDWOLF PROVIDES THE SERVICES “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE.” AARDWOLF DOES NOT PROMISE OR REPRESENT THAT THE SERVICES WILL BE ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES WILL PROVIDE SPECIFIC RESULTS.  YOU EXPRESSLY AGREE THAT USE OF THE SERVICES ARE AT YOUR SOLE RISK. AARDWOLF MAKES NO REPRESENTATIONS, WARRANTIES, OR CONDITIONS, EXPRESS OR IMPLIED, AS TO THE SERVICES OR THE INFORMATION, CONTENT, AND MATERIALS INCLUDED VIA THE SERVICES, OR OTHERWISE, AND DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY, AND IMPLIED, INCLUDING WITHOUT LIMITATION (1) WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE EFFORT, AND ACCURACY, (2) WARRANTIES OR CONDITIONS ARISING THROUGH COURSE OF DEALING OR USAGE OF TRADE, AND (3) WARRANTIES OR CONDITIONS THAT ACCESS TO OR USE OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR SOLE REMEDY AGAINST AARDWOLF FOR DISSATISFACTION WITH THE SERVICES IS TO STOP USING THE SERVICES. 

Aardwolf reserves the right to do any of the following, at any time, without notice: (1) to modify, suspend, or terminate operation of or access to the Services, or any portion of the Services, for any reason; (2) to modify or change the Services, or any portion of the Services, and any applicable policies or terms; and (3) to interrupt the operation of the Services, or any portion of the Services, as necessary to perform routine or non-routine maintenance or other necessary reasons.  

Limitation of Liability

 Aardwolf shall not be liable for any form of damages, whether direct, indirect, consequential, punitive, or otherwise for any act, failure to act, or omission.  Your sole remedy against Aardwolf for any damages shall be the amount paid for the Services in dispute, and by using Aardwolf’s Services, you agree that such limitation is reasonable.  In the event of any error or omission by Aardwolf, Aardwolf’s liability shall be limited to re-testing of the sample at Aardwolf’s cost.  Any error or omission must be brought to Aardwolf’s attention within thirty (30) days of the date the testing results were provided to you.  In order to exercise your rights under this paragraph, you must email info@aardwolf-labs.com and request a new test and, if necessary, provide new samples for testing.  Otherwise, Aardwolf shall have no liability, obligation, or responsibility for any loss, costs, or claims, whatsoever, whether as direct, indirect, or consequential damages, except as otherwise provided in this paragraph.

Indemnification

You agree to indemnify and hold Aardwolf and its affiliates and subsidiaries harmless from any and all claims, losses, or causes of action arising out of or relating to your use of the Services or any breach by you of these Terms or other specific instructions provided by Aardwolf to you.

Governing Law and Venue

These Terms and the Services shall be governed by the laws of the state of the jurisdiction within which the Services were performed and you agree that any claim or cause of action arising out of or relating to these Terms or the Services shall be brought in the state district court in said jurisdiction.

Attorney Fees and Costs

In the event litigation is brought relating to or arising out of these Terms or the Services, you agree to pay all of Aardwolf’s reasonable attorney fees, costs, and expert witness fees in the event it prevails.

Severability

In the event a particular provision of these Terms is found to be illegal or unenforceable, only the offending portions shall be stricken and the remaining portions of these Terms shall remain in full force and effect.
